Acceptable Use Policy

This Virtunio Ltd. Acceptable Use Policy (the "Use Policy") sets out the rules applied to the use of services and systems as indicated in the Virtunio Ltd. Terms of Service.

LightningBytes is a proxy reseller. We resell proxy infrastructure services supplied by our network suppliers (our "Suppliers"). Because the Services are supplied through our Suppliers' networks, you must also comply with our Suppliers' acceptable-use rules, which are incorporated by reference.

BY USING THE SERVICES, YOU AGREE TO THIS USE POLICY. IF YOU DISAGREE WITH ANY PART OF IT, YOU MUST NOT USE OR MUST IMMEDIATELY CEASE YOUR USE OF THE SERVICES.

1. General provisions and definitions

Virtunio Ltd. is a legal entity incorporated in Republic of Cyprus (European Union). Any person using our Services or System is considered a Client ("you"). The Company and the Client are bound by the Terms of Service, which governs the contractual relationship between us.

LightningBytes provides IP address proxy infrastructure solutions, including residential and mobile proxies, by reselling services supplied by our network suppliers. The Services can be reached and used via the System.

This Use Policy is applicable and interpreted in line with the Terms of Service. We may modify this Use Policy at any time without notice. Your continued use of the Services constitutes acceptance of the updated version. For matters regarding this Use Policy, contact us at legal@lightningbytes.com.

2. Prohibited activities and content

Below is a non-exhaustive list of the types of prohibited activities and content on or through the System and Services. Prohibited activities are any acts or content that offend against, are objectionable to, or are contrary to the public interest, public morality, public order, public or national security, or are otherwise prohibited by any applicable law, regulation, order, or requirement.

While using the System and Services, you agree not to, and will not assist, encourage, or enable others to use the System and Services for any of the following Prohibited Activities:

  • Distribute cracks, warez, ROMs, viruses, adware, worms, trojan horses, malware, spyware, or any other similar malicious software, or any computer code, files, or programs designed to interrupt, hijack, limit, destroy, or negatively affect the functionality of any computer software, hardware, network, or telecommunications equipment.
  • Cause any network resource to be unavailable to its intended users, including via denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
  • Cause any damage or service disruption to any third-party computers or service.
  • Deploy, distribute, or cause the execution of any code that gathers personal information of end users or device owners, or that manipulates devices, without those persons' knowledge and consent.
  • Engage in or encourage any unlawful activity, including but not limited to theft, fraud, robbery, forgery, bribery, blackmail, threats, commercial cheating, money laundering, smuggling, or any other crime punishable by law.
  • Distribute any unlawful and illicit content, including content that promotes terrorism, child exploitation, or violence.
  • Engage in or encourage discrimination, racism, contempt of religion, hate speech, or incitement to hatred between individuals and groups.
  • Violate third-party intellectual property rights, including downloading or distributing pirated material, encrypted TV or radio channels, or any other form of intellectual property infringement.
  • Commit, engage, or encourage any type of fraud, including click fraud, generating fake traffic, or falsely increasing a site's audience.
  • Create dishonest social engagement such as operating fake social-media profiles, creating fake reviews, leaving fake likes or generating fake shares or comments, or conducting romance or similar scams.
  • Conduct privacy invasion, including phone tapping, espionage, theft or publication of private information, or tracking, recording, or intercepting communications without right.
  • Enhance or operate a service or entity that competes with the Services, or assist any other party to do so.
  • Reproduce, duplicate, copy, resell, or otherwise commercially exploit any part of the Services, any material of the System, or any intellectual property rights of the Company without written permission.
  • Overload the System or conduct scraping or data collection that violates this Use Policy, applicable laws, or third-party terms.
  • Transfer your Account to any third party, including selling, gifting, or granting access, without the Company's explicit prior consent.
  • Abuse or misuse any free trial, including attempts to circumvent eligibility criteria or obtain multiple trials.
  • Circumvent the Company's identity verification processes, including creating multiple accounts using the same identity document.

The list above is non-exhaustive. As our Supplier is incorporated in the United Arab Emirates, certain uses of the Services may also be subject to UAE law, including UAE Federal Decree-Law No. (34) of 2021 On Countering Rumors and Cybercrimes. You are solely responsible for ensuring your activities comply with all applicable laws in your jurisdiction and in the jurisdiction of our Supplier.

3. Public web data

You must not access content that is behind a login, paywall, DRM, or any other form of protection without clear authorization.

You must not circumvent or attempt to circumvent access controls, robots.txt directives, API limitations, technical rate limits, or other contractual or technical restrictions imposed by third-party platforms or websites.

When targeting third-party websites or platforms, you must respect the platform's terms and applicable policies.

  • You must not reupload, redistribute, or publicly perform collected content without permission or another lawful basis.
  • You must not use collected content for monitoring or surveillance of identifiable natural persons.
  • You must not make excessive requests or otherwise disrupt third-party services or our infrastructure.
  • You must not misrepresent affiliation with any third-party platform, creator, or rights holder.

4. Blocked websites and vulnerability disclosure

To protect your and the public's interests, we and our Supplier continuously work to make the System and Services safer. We reserve the right to block access to any website while using the System and Services at our sole discretion.

Our Supplier currently blocks several websites for all Clients using Residential Proxies and for all Clients using Datacenter and Static Residential Proxies. The full and up-to-date lists of blocked websites are maintained by our Supplier and are available at the Supplier's documentation. Some blocked websites may become accessible after you complete identity verification.

We reserve the right to add or retract any website or content blocking at any time and at our own discretion. You should always check the available and up-to-date information regarding website and content blocking before using the System and Services.

We encourage you to share information on any violations of this Use Policy, any websites or data we should consider blocking, and any security or technical issues you notice in the System or Services. Contact us at support@lightningbytes.com.

5. Liability

You are expected to exercise reasonable personal judgement when deciding which information, website, or action is considered prohibited.

In addition to the liability clauses set forth in the Terms of Service, you agree to defend, indemnify, and hold harmless the Company, its affiliates, its Supplier, and each of their respective directors, officers, employees, and agents from and against any and all third-party claims, demands, and liabilities, including reasonable attorney's fees, resulting from or arising out of your failure to comply with your obligations under any and all laws, rules, or regulations applicable to you under the Terms of Service and this Use Policy, as well as for any breach or violation of the rules of this Use Policy.

6. Miscellaneous

The English language version of this Use Policy is the prevailing version to any other possible version.

Certain provisions of this Acceptable Use Policy which by their nature are intended to survive, including but not limited to clauses relating to prohibited content and behavior, privacy violations, intellectual property infringements, and liability obligations, shall remain in full force and effect even after you cease using the Account, Services, or System.
